1 Basic principles with regard to processing of personal data on Fyesta

Fyesta is dealing with data protection on the basis of the following principles:

i) Fyesta collects, processes and uses your personal data in compliance with the privacy policy laws of the Federal Republic of Germany and the privacy terms of the European Union.

ii) Fyesta solely uses your personal data to enable you to use the internet service of Fyesta which requires registration. Under no circumstances will Fyesta share your personal data with third parties for promotion or marketing purposes or share them in any other way with third parties.

2 Registration Data

In order to make the service work, Fyesta needs to collect certain personal data from you during the registration process and processes this data. This data is initially your email address, your username and your password.

Your password is never visible to any other Fyesta users at any time. Fyesta will never disclose your password to a third party and/or share it with any third party.

Your username however is your unique identification on Fyesta. It will be publicly visible on Fyesta including all content created, shared and distributed by you (e.g. your profile, your event participations, your comments and your messages).

3 Profile data and posted content

In addition to the mandatory entries during the registration process, your are able to enrich your profile site with additional data.

You username is visible to any other user at any time. It is considered to be your unique identification on Fyesta. All content created by you on Fyesta (e.g. posted events or comments) will usually be displayed together with your username and your profile picture. Your username is linked to your profile page.

Furthermore you are able to distribute your event participations or other activities to third party services like Facebook or Twitter. You can opt in and opt out to do so at any time. During the registration process you will be asked to grant this permission to Fyesta. If you like to change your decision later, just go to “Settings“ in your personal area and choose “Social Networks”. There you can connect and disconnect your Fyesta account with third party services like Facebook or Twitter at any time.

4 Use and transfer of personal data

If you have provided personal data to us, we only use this data for providing the services chosen by you, to reply to your inquiries, transact contracts which we have concluded with you and for technical administration.

Your personal data is only forwarded to third parties or otherwise passed on if this is necessary for the purpose of processing the contract or if you have consented in advance to do so.

You are entitled to withdraw any permission granted with effect for the future at any time.

The deletion of the stored personal data is carried out if you revoke your consent for the storage, if the initial reason of storage is no longer valid, or if the storage is not permitted for any other legal reasons.

If you do not agree with the Privacy Policy, we are not able to provide you with a user account on Fyesta.com

5 Invitations

Being a registered member on Fyesta, your are able to invite other people in order to become a member as well. In this context Fyesta will solely use your personal data in order to process the invitation. Your personal data will not be used for any other purposes.

Please note, when inviting other people, the following data will be shown to the recipient of your invitation:

Your username, your email address.

6 Newsletter, weekly status updates

Fyesta might regularly send out newsletters and info alerts (hereafter known as “newsletter“) via e-mail to registered users. In this newsletter Fyesta will provide you with news related to the service as well as inform you about your personal statistics at the end of the current week.

Fyesta might also introduce to you new features and new content in the newsletter.

You can unsubscribe from this newsletter at any time. In order to do so, please go to “Settings“ > “Notifications” in your personal area.

7 Cookies

After your registration (with e-mail address and password), the Fyesta services use cookies with which you can be identified during your visit to the platform. A cookie will be saved on your computer. To enable automatic login, you can permanently store this cookie on your computer by using the "Remember me" functionality. The cookie then contains parts of your login information in an encrypted format.

8 Log file data

Every time you access the Fyesta page, access data is stored in a file, the server-log. The stored date in the server-log contains your IP address (with which your computer can be identified), the remote host (name and IP address of the computer, which requests the site), time, status, transferred data volume as well as the referrer (the site from where you were linked to the requested site) and product- and release version information of the used internet-browsers (user agent).

The data in the server-log (log file) is collected anonymously and used for statistical purposes in order to analyze users’ behavior as well as for the detection of faults regarding links or the software. Conclusions about your person are not possible.

Fyesta reserves the right, to review the log file data, via the last known IP address, of those members who raise the suspicion to use the Fyesta website and/or the Fyesta services in contravention of the law or contrary to contract.

9 Usage of Google Analytics

This website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Fyesta reserves the right to change these privacy policies at any time. This might be necessary due to subsequently recognized gaps in the regulations or due to new services provided by Fyesta. Fyesta will inform you about all changes of this Privacy Policy by e-mail to the e-mail address you entered at the time of registration.

On written request we will be pleased to inform you about the data stored with regard to your account.

You can access and print this Privacy Policy using the “Privacy Policy” link in the footer of every page of the Fyesta website.

By applying all technical and organizational possibilities, we try to store your personal data in such a way that they are not accessible for third parties. With regard to the communication via e-mail, we can’t completely guarantee the safety of your data and for this reason, we recommend you to send confidential information through the post.
