Fyesta Terms and Conditions (Terms of Use)

1 Use of the service Fyesta.com

This agreement sets forth the legally binding terms for your use of the service at http://www.fyesta.com. Fyesta.com offers a service where users are able to share their upcoming travel and event plans with other users. The users have the possibility to let others know about their planned leisure activities as well as search for activities and users.

2 Privacy Policy

(2.1) In order to run the service provided on Fyesta.com it is necessary to store and use your personal information. We collect and use the data submitted by you solely to operate, maintain and provide the functionality of the service.

(2.2) Fyesta will observe the data privacy regulations as required by German law. It comprises particularly „Das Telemediengesetz“ (TMG), „Das Bundesdatenschutzgesetz“ (BDSG), „Die datenschutzrechtlichen Bestimmungen des Telekommunikationsgesetzes“ (§ 85 ff. TKG) and any statutory provisions of the European Union.

3 Membership

(3.1) The membership as well as the use of all services on Fyesta are free of charge. During the registration process a user profile will be created as well as a username and a password. The username and the password are chosen solely by the user. In this context Fyesta members will get access to a password protected log-in area. There users are able to provide additional information and set up their profile as well as create new events/trips, state their participation in existing events/trips, use the mailing functionality, invite friends and manage their personal settings.

(3.2) The Service is available only to individuals who are at least 16 years old.

(3.3) The membership on Fyesta begins when the user completes the registration form including accurate and truthful personal information.

(3.4) Fyesta reserves the right to refuse registration to any person for any reason at any time. Users may request a specific user name, however there is no guarantee to receive. Furthermore users are not able to claim to obtain a requested username.

(3.5) When creating a Fyesta account you must provide accurate and complete personal information. In case of any changes at a later time you are obligated to update your personal data.

(3.6) You will not be able to transfer your membership to other members, users or any other entity.

(3.7) You are able to request the removal of your personal data on Fyesta at any time. In order to do so you will have to send your request via e-mail to info@fyesta.com. After your personal data has been deleted, your membership will be terminated.

(3.8) At the time of the termination of your membership, all your personal data will be deleted by Fyesta. Events, activities and other content created by you will no longer be linked to your personal profile on Fyesta. However the content will remain a part of the service.

(3.9) If you become a registered member on Fyesta you accept to receive an email newsletter with service related information. You are able to opt out at any time by changing the settings in your personal area.

4 User name and profile picture

(4.1) If available, you are free to select any username being subject to following restrictions:
The username shall not
i) violate current German law, the Terms of Use and public morality
ii) seem offensive, vulgar, obscene, racist or pornographic to other users
iii) violate rights of third parties, particularly trademarks and copyrights of other legal entities and individuals
iv) contain the name of other individuals or entities

(4.2) You are also free to choose an appropriate profile picture being subject to following restrictions:
The profile picture shall not
i) violate current German law, the Terms of Use and public morality
ii) seem offensive, vulgar, obscene, racist or pornographic to other users
iii) violate rights of third parties, particularly trademarks and copyrights of other legal entities and individuals
iv) depict any other person than yourself

5 User’s responsibility

(5.1) You are solely responsible for protecting the confidentiality of your password. You are also solely responsible for activity that occurs on your account accessed with your password. You will immediately notify Fyesta via email (info@fyesta.com) of any unauthorized use of your account of which you are aware of.

(5.2) In order to observe legal regulations, particularly the privacy of correspondence and telecommunication, users must handle e-mails and other messages confidentially and may not make them available to any third party without the sender‘s prior consent. This also applies to any names, photographs, telephone and fax numbers, address data, e-mail addresses and/or URLs (Internet addresses). Any known violation, especially any misuse of such data by manual or automatic reading, storage, processing, modification, deletion will be prosecuted by Fyesta.

6 Content creation, User’s obligations

(6.1) You are solely responsible for all information provided during the registration process and thus for the information you provide about yourself as well as for all content you upload, create, share and distribute on Fyesta.

(6.2) You commit yourself not to create, share and distribute any illegal, violence-glorifying, race baiting, racist, defamatory and any other offensive content. You also commit yourself not to create, share and distribute any content which infringes any trademark, copyright or any other right of any other person or entity. Furthermore you commit yourself neither to restrict nor prevent the access to Fyesta by other users nor to disturb or harass other users and not to violate their personal rights through the creation of content (e.g. text and images).

(6.3) You are not allowed to create profiles which may serve to abusively read, store, edit, modify, distribute or transmit information stored or displayed on Fyesta.

(6.4) Furthermore it is categorically prohibited to link to websites which contain illegal content and/or contain content that is liable to corrupt the young.

(6.5) You are not allowed to intercept any e-mail conversations of other users or attempt to do so. You are allowed to use the messaging communication solely for personal, non-commercial use. You must not send any messages for recommending or offering goods or services to other members. You must not play pyramid games, implement contests, games, send letter chains or any similar procedure through this website.

(6.6) You understand and agree that Fyesta has no obligation to publish all content created by you. Fyesta does not guarantee that any content submitted will be available through this service. Furthermore Fyesta may review, remove or block any content at any time.

(6.7) Fyesta reserves the right, but has no obligation, to monitor content created by users in order to identify content which violates the Terms of Use or any other rights.

7 Right of use

(7.1) Creating content on the website, you grant Fyesta a non-exclusive, worldwide, perpetual, irrevocable, free-of-cost right to use, store, modify, reproduce, distribute, sublicense and create derivative products of, such content in any format, medium or media channel known today or later developed. The same is true in case of termination of a Fyesta membership, except for personal data. You represent and warrant that you have sufficient rights to grant this license to Fyesta as described above.

8 Consequences of Terms of Use Violation

(8.1) In case of Terms of Use violation, particularly violation of any regulation stated in § 6, Fyesta reserves the right to terminate your access to the service without notice, refund or liability of any kind and without giving any reason. It might result in the forfeiture and destruction of all information associated with your Fyesta membership. Furthermore Fyesta reserves the right to pursue any appropriate legal remedies, especially the right to claim for any compensation.

(8.2) Verstößt ein Nutzer gegen eine oder mehrere Bestimmungen des §6, ist der Nutzer, soweit er volljährig ist, verpflichtet, eine vom Betreiber nach billigem Ermessen festzusetzende Vertragsstrafe auf erstes Anfordern an den Betreiber zu zahlen. Diese Vertragsstrafe ist im Streitfall vom zuständigen Gericht zu überprüfen. Des Weiteren ist der Nutzer, soweit er volljährig ist, in einem solchen Fall verpflichtet, unverzüglich nach Aufforderung durch den Betreiber eine nach juristischen Standards übliche vertragsstrafenbewehrte Unterlassungsverpflichtungserklärung abzugeben.

(8.3) Der Nutzer verpflichtet sich, soweit er volljährig ist, Fyesta von jeglicher Art von Klagen, Schäden, Verlusten oder Forderungen schadlos zu halten, die durch einen Missbrauch eines Dienstes von Fyesta durch den Nutzer und den Verstoß gegen diese AGB entstehen könnten. Soweit der Nutzer volljährig ist, verpflichtet er sich insbesondere, den Betreiber von jeglicher Haftung und von allen Verpflichtungen, Aufwendungen und Ansprüchen, die sich aus Schäden wegen Verleumdung, übler Nachrede, Beleidigung, der Verletzung von Persönlichkeits-, Wettbewerbs-, Urheber- und/oder Markenrechten, des Ausfalls von Dienstleistungen für andere Nutzer, der Verletzung von Immaterialgütern (Marken, Urheberrechte, etc.) oder sonstiger Rechte ergeben, freizustellen. Diese Freistellungsverpflichtung umfasst in diesen Fällen auch die zur Abwehr derartiger Forderungen erforderlichen Kosten der notwendigen Rechtsverteidigung (z.B. Rechtsanwaltskosten).

(8.4) Fyesta hat das Recht, die §9 (2) und (3) auch bei Nutzern anzuwenden, die zwar noch nicht volljährig sind, aber über die erforderliche Einsichtsfähigkeit und Schuldfähigkeit verfügen.

9 Hacking

Electronic attacks of any kind against the platform Fyesta.com, the database, the network of Fyesta or against individual users are strictly prohibited. Any electronic attack will provoke the immediate exclusion of the user and leads to legal action. Electronic attacks especially comprise - but are not limited to:
i) hacking attempts, e.g. an attempt to overcome, circumvent or invalidate in any other manner the safety barriers of Fyesta
ii) the use of computer programs for the automatic reading of data, such as crawlers (alias spiders or robots, briefly: bots)
iii) the intentional use and/or the dissemination of viruses, worms and trojans
iv) the use of links, programs or other procedures intended to damage the platform, database or network of Fyesta or of individual users
v) brute force attacks
vi) massive spamming
In case of an infringement of the prohibition of electronic attacks, the user commits himself to pay a contractual penalty using equitable discretion immediately after having been requested to do so by Fyesta. The minimum value of the contractual penalty amounts to EUR 5,001. Fyesta reserves the right to determine the contractual penalty by a court. The assertion of any further claims for damages remains unaffected.

10 Liability

(10.1) This site is provided without warranty of any kind. The provider does not guarantee the uninterrupted availability of Fyesta.com. The website may be temporarily not available due to technical disorder or maintanance work. Fyesta shall not be liable for any loss or damage, whether direct, indirect, special or consequential, arising out of the use of or the inability to use the service. All direct or indirect risk related to use of this site is borne entirely by you, the user.

(10.2) The provider cannot be held liable for any economic, physical or immaterial damage arising from the use of this platform.

(10.3) Since Fyesta offers a platform to display third party content, the provider does not endorse, internalize, agree or comment that content. The users and the appropriate content providers are solely responsible for the created, shared or distributed content. Fyesta expressly excludes any and all liability in connection with that content. If Fyesta becomes aware that any user’s content infringes its Terms of Use, the provider will react appropriately in accordance with the Terms of Use. In case where infringement of the Terms of Use is only suspected, Fyesta will not be liable for missing measures, unless the irregularity may be proved.

11 Final provisions

(11.1) These Terms of Use shall be governed by the laws of Germany.

(11.2) The place of jurisdiction will be Berlin, Germany.

(11.3) Fyesta reserves the right, at is sole discretion, to modify or replace any Terms of Use, disclaimers and provisions at any time with effect as of a future date.

(11.4) Should one or more clauses of the Terms of Use be or become invalid or partly incomplete or unenforceable the other clauses of the Terms of Use shall not be affected. The invalid condition is considered as replaced by such condition closest to the essence and purpose of the invalid one. The same refers to any missing items in the Terms of Use.
